{"id":1424,"date":"2020-01-02T18:44:48","date_gmt":"2020-01-02T17:44:48","guid":{"rendered":"https:\/\/johan-callewaert.eu\/?p=1424"},"modified":"2020-01-03T17:15:30","modified_gmt":"2020-01-03T16:15:30","slug":"judgment-of-the-cjeu-in-the-case-of-ah-and-others","status":"publish","type":"post","link":"https:\/\/johan-callewaert.eu\/fr\/judgment-of-the-cjeu-in-the-case-of-ah-and-others\/","title":{"rendered":"Judgment of the CJEU in the case of AH and Others"},"content":{"rendered":"\n<p>In <strong>AH and Others<\/strong> (5.9.2019) the CJEU applied <strong>Directive 2016\/343 on the presumption of innocence<\/strong> <strong>and the right to be present at the trial in criminal proceedings<\/strong> to an agreement with the prosecution in which only one of the co-accused persons had recognized his guilt in exchange for a reduction in sentencing. In doing so, the CJEU considered:<\/p>\n\n\n\n<p>\u201c\u2026 it should be noted that the presumption of innocence is enshrined in Article\u00a048 of the Charter, which corresponds to Article\u00a06(2) and (3) of the ECHR, as is apparent from the explanations to the Charter. It follows, in accordance with Article\u00a052(3) of the Charter, that it is necessary to take account of Article\u00a06(2) and (3) of the ECHR for the purposes of interpreting Article\u00a048 of the Charter, as a minimum threshold of protection\u2026\u201d (\u00a7 41)<\/p>\n\n\n\n<p>In light of the above, the CJEU then relied on the judgments of the ECHR in the cases of <em>Karaman v. Germany <\/em>(27.2.2014) and <em>Navanyy and Ofitrov v.
